Legal Schizzle

The AI already knows everything about you anyway.

Privacy policy and legal notices from Patman.AI. Clearly structured, no drama, with a dry wink at the beginning.

Published on 12 May 2023

Translated from German

Legal texts are the spinach of the website world. You'd rather dive headfirst into the exciting content; instead, you get legalese and fine print. I'm about equally thrilled. Enjoy. Or not.

A little secret between you and me: This disclaimer wasn't born in a blaze of original thought. It followed more of a "found it, liked it, pasted it" approach. And yes, the funny thing is that I don't even actively use half of the services mentioned here. It's a bit like buying a Swiss Army knife when you really just needed a toothpick.

Privacy Policy

This privacy policy explains how Patman.AI processes personal data when you use this website or contact me. It is based on Swiss data protection law (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). The currently valid version is published on this website. I may update it at any time.

Responsible Entity

The responsible entity (controller) within the meaning of data protection laws, in particular the GDPR, is:

Patman Spahr
Email: human@patman.ai

General Information

Based on Article 13 of the Swiss Federal Constitution and federal data protection provisions (Data Protection Act, FADP), every person has the right to the protection of their privacy and protection against the misuse of their personal data. I treat personal data confidentially and in accordance with statutory data protection regulations as well as this declaration. In cooperation with hosting providers, I endeavor to protect systems and databases as best as possible against unauthorized access, loss, misuse, or falsification. Nevertheless, complete protection during data transmission over the Internet cannot be guaranteed.

You can generally visit this website without registering. Technical data such as pages accessed or file names, date, and time may be stored on the server for statistical purposes without these data being directly attributed to you personally. As far as possible, I collect personal data such as name, address, or email address on a voluntary basis. I do not share this data with third parties without your consent.

Definitions and Basic Principles

Personal data means any information relating to an identified or identifiable person. Data subjects are individuals whose personal data is processed. Processing encompasses any handling of personal data, regardless of the means and procedures applied, in particular storing, disclosing, acquiring, deleting, retaining, modifying, destroying, and using.

I process personal data in accordance with Swiss data protection law. In addition, to the extent the GDPR applies, I process personal data in accordance with the following legal bases under Art. 6(1) GDPR. I process personal data only for as long as necessary for the respective purpose. If longer statutory retention obligations exist, I restrict processing accordingly.

Legal Bases under the GDPR (Selection)

Consent (Art. 6(1)(a), Art. 7 GDPR).
Contract and pre-contractual inquiries (Art. 6(1)(b) GDPR).
Legal obligation (Art. 6(1)(c) GDPR).

Additional Bases

Vital interests (Art. 6(1)(d) GDPR).
Legitimate interests (Art. 6(1)(f) GDPR).
Application procedures (Art. 9(2)(b) GDPR). In the case of voluntary consent, Art. 9(2)(a) GDPR applies.

Security Measures

I take appropriate technical and organizational measures in accordance with legal requirements. In doing so, I take into account the state of the art, implementation costs, as well as the nature, scope, circumstances, and purposes of the processing, alongside the risk to the rights and freedoms of natural persons. These include, in particular, measures ensuring the confidentiality, integrity, and availability of data. They also encompass controls over physical and electronic access as well as procedures for data subject rights, deletion, and responding to data breaches.

SSL/TLS Encryption

This website uses SSL/TLS encryption for security reasons and to protect confidential content. You can recognize an encrypted connection by "https://" and the lock icon in the browser address bar. When encryption is enabled, transmitted data cannot be read by third parties.

Disclosure, Recipients, and Data Processors

In the course of my processing, data may be transmitted or disclosed to other bodies, companies, organizationally independent units, or persons. Recipients may include, for example, IT service providers or providers of services and content integrated into the website. In such cases, I comply with statutory requirements. In particular, I conclude appropriate contracts or agreements to protect your data.

Data Processing in Third Countries

If I process data in a third country—that is, outside the EU or the EEA—or if this occurs in connection with third-party services, this is done solely in accordance with statutory requirements. Subject to express consent or contractually or legally required transmission, I only process data in third countries with an officially recognized adequate level of data protection. Alternatively, processing is based on standard data protection clauses of the EU Commission, on certifications, or on binding corporate rules (Articles 44 to 49 GDPR; EU Commission information page: https://ec.europa.eu/info/law/…).

Notice on Data Transmission to the USA

Tools from companies based in the USA are integrated into my website, among other things. When these tools are active, personal data may be transferred to US servers of the respective providers. Please note that the USA is not considered a safe third country within the meaning of EU data protection law. US companies may be obligated to hand over personal data to security authorities without data subjects having effective legal remedies. I have no influence over this.

Cookies and Consent

This website uses cookies. Cookies are text files containing data from visited websites or domains that are stored on your device by the browser. They primarily serve to store information about users during or after their visit—for instance language settings, login status, shopping cart contents, or the point in time a video was viewed. Comparable technologies that perform the same function, such as pseudonymous online IDs or user IDs, are also regarded as cookies.

Cookie Types (Selection)

Temporary cookies (session cookies). Deleted at the latest when you close your browser.
Persistent cookies. Remain stored even after closing the browser, for instance to remember login status or preferred content.
First-party and third-party cookies. Set by me or by third-party providers.

Purposes, Duration, Opt-out

Necessary cookies are required for operation, security, or forms. Statistics, marketing, and personalization cookies are used for reach measurement, interest profiling, and personalized content.
Storage duration of persistent cookies can be up to two years, unless stated otherwise.
Revocation and objection are possible at any time, for example via browser settings. Opt-outs for online marketing: https://optout.aboutads.info and https://www.youronlinechoices….

Cookie Consent Management: I use a procedure to manage cookie consent. Consents are stored so that they do not have to be requested repeatedly and can be proven if necessary. Storage may take place server-side and/or via an (opt-in) cookie. The storage period can be up to two years. In the process, a pseudonymous identifier may be generated, along with the timestamp and scope of consent, as well as details about the browser, system, and device used.

Processed data: Usage data (e.g., visited pages, access times), metadata and communication data (e.g., device information, IP addresses). Data subjects: Users (website visitors). Legal bases: Consent (Art. 6(1)(a) GDPR), legitimate interests (Art. 6(1)(f) GDPR).

Third-Party Services (General)

This website may use Google Maps (map integration), Google Invisible reCAPTCHA (protection against bots and spam), and YouTube (video integration). These services from Google LLC (USA) utilize cookies, among other things. This may result in data being transferred to the USA. I assume that pure use of my website does not result in any personal tracking in this context.

According to this template, Google has committed to ensuring adequate data protection under the US-European and US-Swiss Privacy Shield frameworks. For more information, please refer to Google's privacy policy.

Contact Form

If you contact me via the contact form, I will store your details, including contact information, to process the inquiry and for follow-up questions. This data will not be shared without your consent.

Newsletter

If you wish to receive the newsletter, I require an email address as well as information that allows me to verify that you are the owner of the email address and agree to receive it. No further data is collected. The data is used exclusively for dispatch and is not disclosed to third parties. You can revoke your consent at any time, for instance via the unsubscribe link in the newsletter.

Google Maps

This website uses Google Maps. This allows interactive maps to be displayed directly on the website. Upon visiting, Google receives the information that you accessed the corresponding subpage, regardless of whether you have a Google account. If you are logged in to Google, data will be assigned to your account. If you do not wish this, please log out before using the feature.

Google stores data as usage profiles and can use them for advertising, market research, and tailored website design. You have the right to object to the creation of these user profiles; please contact Google directly to exercise this right. For more information: www.google.de/intl/de/policies…

Google Remarketing

This website uses the remarketing feature of Google Inc. to display interest-based advertising within the Google advertising network. For this purpose, a cookie is stored in the browser that enables recognition. According to Google, no personal data is collected in the process. You can deactivate remarketing via http://www.google.com/settings…. Alternatively, you can disable interest-based advertising via https://thenai.org/opt-out/.

Google reCAPTCHA

I use Google reCAPTCHA (Google Ireland Limited, Dublin) to check whether entries are made by human beings or automated programs. For this purpose, reCAPTCHA analyzes behavior on the website (e.g., IP address, duration of visit, mouse movements). The data is forwarded to Google. The analysis runs entirely in the background.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in protecting against misuse and spam). Further information: https://www.google.com/intl/de… and https://policies.google.com/te….

Google Analytics

This website uses Google Analytics (Google Ireland Limited). If the responsible controller is located outside the EEA or Switzerland, processing is carried out by Google LLC. The aim is to obtain statistics to improve my offering. This website also uses Google Analytics for cross-device analysis via User ID. If you have a Google account, you can deactivate this in your Google settings under "My data" and "Personal data".

The legal basis is Art. 6(1)(f) GDPR. The IP address is not merged with other Google data. In addition, Google Analytics on this website has been extended with "_anonymizeIp();" so that IP addresses are only processed in truncated form. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.

Google Analytics uses cookies. You can refuse cookies in your browser, though this may restrict functionality. You can also prevent data collection by installing a browser plugin: Deactivate Google Analytics. Alternatively, you can set an opt-out cookie via a link: Deactivate Google Analytics. If you delete all cookies, opt-out cookies must be set again.

Google AdSense

I use Google AdSense (Google Ireland Limited) to display contextually relevant advertising. AdSense uses cookies to deliver more relevant ads, improve reporting, and avoid repeating ads. Google can also use cookie IDs to record conversions (e.g., when a purchase is made after viewing an ad). According to Google, Google Ads cookies do not contain personal data.

Through this integration, your browser can establish a direct connection to Google servers. Google thereby receives information, among other things, that you accessed a page on my website or clicked on an ad. If you are registered with Google, Google can assign the visit to your account. Even without logging in, Google may obtain and store your IP address.

Preventing Tracking (Selection)

Configure browser settings to block third-party cookies.
Deactivate conversion tracking cookies, e.g., by blocking the domain "https://ads.google.com/" or via https://adssettings.google.com (setting will be reset when cookies are deleted).

Additional Options

Deactivate interest-based advertising via https://optout.aboutads.info/ (will be removed when cookies are deleted).
Permanently deactivate via https://www.google.com/setting…. Some functions may then be limited.

The legal basis is a balancing of interests pursuant to Art. 6(1)(f) GDPR. Further info: https://ads.google.com/intl/de… as well as https://www.google.de/intl/de/… and https://www.networkadvertising….

In short

I collect as little as possible, protect as much as makes sense, and let you know which tools are involved as soon as they come into play. If you have questions, reach out. Then we'll talk straight. If you really read all the way down to this point, I'm impressed—and slightly worried about you.
